
The purpose of the Pesticide and Manure Licensing Program is to ensure safe and proper distribution and application of pesticides and manure through education and technical support to dealers and applicators. Certification and licensing requirements are outlined in the Pesticides and Fertilizers Licence Regulation and the Manure Regulation under The Pesticides and Fertilizers Control Act.

Steps to become Licensed:
1. Certification - Individuals wishing to
become licensed must demonstrate that they are qualified to sell
or apply pesticides or to apply manure through manure through
certification training. Certification courses and exams for the
Pesticide and Manure Licensing Program are administered by
Assiniboine Community College.
2. Insurance - Individuals applying for a Pesticide Applicator
or Manure Applicator Licence are required to have general
liability insurance. Pesticide Applicators must also have
pesticide drift insurance.
3. Licence - Send completed and signed licence application forms
and licence payment to Manitoba, Agriculture, Food and Rural
Initiatives. Proof of certification and insurance must be
submitted with licence applications.

Q. Do I need a licence under the Act?
The Act requires retail pesticide dealers, commercial pesticide
applicators, and commercial and off-farm manure applicators to
be licensed.
A pesticide dealer licence is required to sell pesticides to
an end user.
A pesticide applicator licence is required to apply pesticides
for a fee or reward. Farmers also require a pesticide applicator
licence if off-farm pesticide application exceeds 500 hectares
or if off-farm pesticide application is carried out for more
than three individuals a year.
A commercial manure applicator licence is required to apply
manure for a fee or reward. An off-farm manure applicator
licence is required to apply manure to land not owned or leased
by the applicator if manure is produced by a farm with 300
animal units or more.
Q. What pesticides come under licensing?
Pesticides regulated under the Act include commercial and
restricted class herbicides, fungicides, insecticides and
vertebrate pest control products. Herbicides control weeds,
fungicides control plant diseases, insecticides control insect
pests, and vertebrate pest control products control nuisance
vertebrate pests. Domestic and restricted class animal
repellents containing capsaicin (i.e. pepper sprays) are also
included under the Act.
Q. Does the Act require licensing of home and garden
pesticides?
No. Home and garden pesticides are classified as domestic
pesticides and are exempt from the Act by regulation. Only
commercial and restricted class pesticides are regulated under
the Act and require licensing.
Q. Is a licence required for fertilizers?
A licence is required for manure application only. Inorganic
fertilizers are exempt from the Act by regulation and do not
require a licence for sale or application.
Q. Are wholesale pesticide vendors or distributors
required to be licensed?
No. Wholesale pesticide vendors do not require a licence;
however they are required to distribute pesticides to licensed
pesticide dealers only.
Q. Does everyone who sells pesticides require a licence?
At least one licensed staff member must be available at a
pesticide retail outlet during store hours. Every retail sale of
commercial and/or restricted class pesticides must be made by a
licensed pesticide dealer. Every business outlet must ensure all
staff selling pesticides are licensed.
Businesses that sell pepper sprays must also have a licence.
These businesses must designate an individual who is responsible
for the licence and for other staff that sell theses products.
Q. Who needs an applicator licence?
Individuals that commercially apply pesticides for agricultural,
non-agricultural, structural and landscape pest control purposes
require a pesticide applicator licence. Farmers that apply
pesticides to more than 500 hectares of farm land they do not
own or that apply pesticides for more than three individuals a
year also require a pesticide applicator licence.
Individuals that commercially apply manure require a manure
applicator licence. Individuals or a group of individuals that
apply manure to land not owned or leased by the individual or
group require an off-farm manure applicator licence if the
manure is produced by 300 animal units or more.
Q. Who is exempt from licensing?
Individuals do not require a pesticide applicator licence if the
total pesticide application completed off his or her farm is
less than 500 hectares and the work is carried out for not more
than three individuals in any year.
Individuals or a group of individuals do not require a manure
applicator licence if manure is applied to land owned or leased
by the individual or group and if manure is produced by less
than 300 animal units.
Q. What are the specific licensing categories?
Pesticide Dealer Licence:
Agricultural ground – sale of
pesticides for use on agricultural land.
Livestock – sale of pesticides for
veterinary use.
Structural – sale of pesticides for
use on structural pests.
Pesticide Applicator Licence:
Aerial – pesticide application by
aerial equipment.
Agricultural ground – pesticide
application on agricultural land by ground equipment.
Forestry – pesticide application to
forest areas.
Greenhouse – pesticide application
(excluding the use of restricted fumigants) in and immediately
around greenhouses
or interior plantscape structures.
Industrial – pesticide application on
rights-of-way or industrial sites.
Landscape/Golf Course – pesticide application to trees, lawns, boulevards and golf courses.
Mosquito control -
pesticide application to control mosquitoes and biting flies.
Rural Municipal – pesticide
application to industrial areas including roadsides, power
lines, pipelines, rights-of-ways, well
sites, non-cropland and equipment
yards. This category also includes use of herbicides on pastures
and rangeland,
outdoor residential property,
commercial property (e.g. cemeteries and municipal golf courses)
and for the control of
noxious weeds.
Seed treatment – pesticide
application to seed.
Stored
Agricultural Products – pesticide application to control insects
of stored grain (farms and grain elevators) and
stored grain products (flour
mills and grain product storage facilities).
Structural – pesticide application in
and around commercial or residential dwellings, storage
warehouses and other
structures.
Manure Applicator Licence:
Commercial Manure Applicator – Liquid – commercial
application of liquid manure.
Commercial Manure Applicator – Solid – commercial
application of solid manure.
Off-farm Manure Applicator – Liquid – off-farm
application of liquid manure.
Off-farm Manure Applicator – Solid – off-farm application
of solid manure.
Q. Which licence does a seed treatment operator require?
A seed treatment operator requires a pesticide dealer licence to
sell seed treatment pesticides or any other pesticides to an end
user. A pesticide applicator licence is required if the operator
is treating someone else’s seed for a fee. A pesticide dealer or
applicator licence is not required if the operator is treating
his or her own seed for sale to someone else.
Q. What is the licence fee?
The current fee for a pesticide dealer, pesticide applicator,
and manure applicator licence is $50.00. The licence renewal fee
is $50.00.
Q. Can a licence be obtained anytime?
Yes, a licence may be obtained anytime it is required, before or
within the licensing year of January 1 to December 31.
Q. How long are the licenses valid?
Licenses are valid for up to a one-year period, from January
1(or date of issue) to December 31.
Q. How do I apply for a license?
Licence application forms are automatically mailed out to every
person who successfully completes the required certification
course and examination. Application forms for licence renewals
are mailed out annually. Application forms are also available
on-line.

Q. What courses are available?
Both pesticide dealers and applicators must take the Pesticide
Core certification course.
Pesticide dealers must also take a dealer course of the
appropriate category to qualify for licensing. Courses are
available for agricultural ground (combined applicator and
dispenser), livestock and structural (combined applicator and
dispenser).
Pesticide applicators must also take an applicator course of the
appropriate category to qualify for licensing. Courses are
available for agricultural ground (combined applicator and
dispenser), aerial, industrial, structural, (combined applicator
and dispenser) landscape pest control, forestry pesticide
application, seed treatment, mosquito control, stored
agricultural products pesticide application, rural municipal
pesticide application, and greenhouse pesticide application.
Commercial and off-farm manure applicators must take the Custom
Manure Applicator course for liquid and/or solid application.

Q. Are examinations required?
Individuals must pass a written examination to receive
certification in a specific licence category.
Q. How often do I need to take a course?
Recertification is required every five years for all licence
categories.

Q. What records do I need to keep as a licensed pesticide
dealer or applicator?
A Record of Pesticides Sold must be kept for the retail sale of
all commercial and restricted pesticides. Licensed dealers must
also keep a Declaration of Purchase Record for the sale of all
restricted class pesticides. These records are to be submitted
to the Minister of Agriculture on or before October 31 of each
year.
A Record of Pesticide Application must be kept by licensed
pesticide applicators. The record must be filled out within 24
hours of each pesticide application and maintained for a minimum
of three years. A Record of Pesticide Application form is not
supplied to pesticide applicators. Record forms must include the
following items:
• Customer’s name
• Mailing address of customer
• Date and time of application,
spraying or treatment
• Legal description of area and total
area
• Type of crop or property treated
• Stage of crop growth
• Weeds, pest or other purpose of
application or treatment
• Wind direction and velocity at time
of application or treatment
• Air temperature at time of
application or treatment
• Name, formulation and concentration
of pesticide used
• Total amount of pesticide applied
• Pest Control Products Act (Canada)
registration number of pesticide used
• Carrier used (water, fuel oil or

Q. What records do I need to keep as a licensed manure
applicator?
A Record of Manure Application must be kept by licensed
commercial and off-farm manure applicators. The record must be

Q. Do I require liability insurance?
Pesticide and manure applicators are required to carry liability
insurance for licensing. Pesticide applicators are required to
have minimum insurance coverage of $250,000 general liability
and property damage exclusive of chemical misuse and spray
drift, and coverage of $25,000 for chemical misuse or spray
drift. Manure applicators are required to have minimum insurance
of $500,000 for general liability and property damage.
Q. Is there an Advisory Committee under the Act?
Yes. The Pesticide Advisory Committee consists of seven members
representing Manitoba Agriculture, Food and Rural Initiatives,
Manitoba Conservation, Assiniboine Community College, CropLife
Canada, Keystone Agricultural Producers, Manitoba Aerial
Applicators Association, and Manitoba Livestock Manure
Management Initiative.
Q. What does the pesticide Advisory Committee do?
The committee advises the provincial Minister of Agriculture on
issues surrounding pesticide regulation and certification.
Q. What penalties are there under the Act?
Penalties under the Act include fines, imprisonment or both.
Individuals that violate or fail to comply with the Act may be
fined $100 to $10,000 or imprisoned for 60 days to six months,
or both.
