
PURPOSE OF PROGRAM/SERVICE
The Farm Machinery Board is established pursuant to The Farm
Machinery and Equipment Act. The purpose of the Act is to provide
Manitoba producers with warranty and repossession protection on farm
machinery and equipment purchased or leased in Manitoba. The Act
provides statutory requirements on the length of warranties,
replacement parts and service, replacement rentals, repossession
procedures, sales contracts and financing arrangements.
The Act requires lenders financing farm machinery by means of a lien
note security document, to apply to the Board for leave to repossess
when an account goes into arrears and before repossession can occur.
Manitoba is the only jurisdiction in Canada requiring a
quasi-judicial body to pass judgment before farm machinery
repossession can take place.
The Act requires that dealers, distributors and manufacturers doing
business in Manitoba be licensed with the Board. The Manitoba farm
machinery dealer network consists of 80 major franchised dealership
premises, sufficient to provide adequate service to the Province's
producers, both in repair parts and mechanical service.
WHO QUALIFIES
Producers, purchasers and dealers who reside in Manitoba and
vendors (distributors and manufacturers) who are licensed within
Manitoba relating to farm machinery and equipment.
AVAILABLE BENEFITS/ASSISTANCE
The Board will provide information and assistance to producers on
statutory warranties on new machinery, repair parts for older farm
machinery and repossession.
The Board will provide information and assistance to dealers when
the dealership agreement (agreement between a dealer and
manufacturer) is terminated.
The Board will provide mediation and arbitration assistance to
producers, dealers and vendors.
