In accordance with the Manitoba Environment Act (C.C.S.M. c. E125)
THIS LICENCE IS ISSUED TO:
THE RURAL MUNICIPALITY OF DUFFERIN; "the Licencee"
for the construction and operation of the Development being a municipal water distribution system in the Rural Municipality of Dufferin subject to the following specifications, limits, terms and conditions:
SPECIFICATIONS, LIMITS, TERMS AND CONDITIONS
- The Licencee shall construct the Development in accordance
with the Environment Act Proposal dated January 8, 1996, and submitted to Manitoba Environment by PFRA on behalf of the Licencee.
- The Licencee shall meet with Manitoba Natural Resources Central Region staff before April 1, 1996 to discuss and agree to the mitigation of construction impacts on wildlife and wildlife habitat.
- The Licencee shall consult with the Technical Services Engineer for Manitoba Highways and Transportation prior to finalizing plans for portions of the Development adjacent to Provincial Roads and Provincial Trunk Highways.
- The Licencee shall obtain all necessary permits and agreements from Manitoba Highways and Transportation and the Highway Traffic Board prior to undertaking construction on or adjacent to highway rights-of-way.
- The Licencee shall, prior to undertaking construction activities, obtain all necessary authorizations from the Water Resources Branch of Manitoba Natural Resources.
- The Licencee shall construct waterway crossings by augering, tunnelling or boring. The prior written approval of the Director shall be obtained before undertaking open cut waterway crossings where fish or fish fry may be present.
- The Licencee shall not undertake construction of stream crossings where fish or fish fry may be present using open cut techniques between April 1 and June 15 of any year.
- The Licencee shall, at any stream crossing constructed using open cut techniques, construct the crossing in accordance with the Canadian Association of Petroleum Producers publication "Watercourse Crossing Guidelines for Pipeline Systems."
- The Licencee shall notify the Regional Fisheries Manager of Manitoba Natural Resources not less than one week before undertaking construction of stream crossings using open cut techniques.
- The Licencee shall obtain and follow advice from the Regional Fisheries Manager with respect to erosion control at open cut stream crossings prior to undertaking construction of stream crossings using open cut techniques.
- The Licencee shall separate and replace topsoil from backhoe and trenching operations in accordance with the methodology described in Figures 1, 2 and 3 attached to this Licence. This requirement is not applicable where the topsoil has been previously disturbed due to the construction of roads or drains.
- The Licencee shall revegetate soil exposed during the construction of the Development with native or introduced grasses or legumes.
- The Licencee shall ensure that check valves are installed where necessary to prevent cross-connections between the Development and existing private water supply systems.
- The Licencee shall, prior to the commencement of operation of the Development, receive the approval of the Director for final plans showing the location of the works associated with the Development.
- The Licencee shall ensure that the operation of the municipal water supply is in accordance with Manitoba Regulations under the Public Health Act and all operating requirements as recommended by Manitoba Environment.
- The Licencee shall ensure that all used oil products and other regulated hazardous wastes generated by the machinery used in the construction of the Development are collected and disposed of in accordance with applicable Manitoba Environment and legislation requirements.
- The Licencee shall ensure that fuel storage areas established for the construction of the Development are located a minimum distance of 100 metres away from any waterbody, and shall comply with the requirements of Manitoba Regulation 97/88R respecting Storage and Handling of Gasoline and Associated Products.
REVOCATION
If, in the opinion of the Director, the Licencee has exceeded or is exceeding the limits, or has not complied or is not complying with the specifications, terms or conditions set out herein, the Director may revoke this Licence either temporarily or permanently.
