THIS LICENCE IS ISSUED TO:

THE RURAL MUNICIPALITY OF DAUPHIN; "the Licencee"

• the Proposal filed under The Environment Act on January 23, 1996;
  
• additional information dated April 11, 1996 and filed by SAE/Sims and Associates Engineers Ltd. on behalf of the Licencee, except as noted in Clause 10 of this Licence; and
  
• Sections A to F and H to K inclusive of the document "Rural Municipality of Dauphin Project Manual Drifting River Ford Crossing" dated June 25, 1996 and filed by SAE/Sims and Associates Engineers Ltd. on behalf of the Licencee;

GENERAL TERMS AND CONDITIONS
This Section of the Licence contains requirements intended to provide guidance to the Licencee in implementing practices to ensure that the environment is maintained in such a manner as to sustain a high quality of life, including social and economic development, recreation and leisure for present and future Manitobans.
1. The Licencee shall ensure that all used oil products and other regulated hazardous wastes generated by the machinery used in the construction and operation of the Development are collected and disposed of in accordance with applicable Manitoba Environment and legislation requirements.

2. The Licencee shall obtain a Work Permit from the local office of Manitoba Natural Resources prior to commencing construction of the Development.

3. The Licencee shall ensure that riprap of adequate size and extent is placed at the ends of the waterway openings in the structure to prevent streambed erosion and the undermining of the structure.

4. The Licencee shall ensure that areas which are disturbed by the construction of the Development are stabilized to prevent water erosion and the establishment of weeds. Bank areas subject to high velocity flows shall be stabilized with riprap. Higher disturbed areas shall be revegetated with native plant species or introduced grasses and legumes.

5. The Licencee shall conduct regular inspections of the Development and remove accumulated debris as necessary to ensure that flow through the waterway openings is not excessively restricted. Displaced riprap shall also be replaced as necessary.
   SPECIFICATIONS, LIMITS, TERMS AND CONDITIONS

6. The Licencee shall ensure that fuel storage areas established for the construction and operation of the Development are located a minimum distance of 100 metres from any waterbody, and shall comply with the requirements of Manitoba Regulation 97/88R respecting Storage and Handling of Gasoline and Associated Products.

7. The Licencee shall ensure that non-reusable demolition debris from the existing bridge is disposed of at a waste disposal ground operating under the authority of a permit issued under Manitoba Regulation 150/91respecting Waste Disposal Grounds.

8. The Licencee shall, following demolition of the existing bridge, arrange for a site meeting with the responsible Environment Officer and the Regional Fisheries Manager of Manitoba Natural Resources. At the meeting, the Licencee or the Licencee's representative shall explain intended right-of-way clearing, cofferdamming procedures, sedimentation control during the construction period, construction procedures, final site drainage patterns and riprapping measures.

9. The Licencee shall, prior to commencing construction of the ford crossing structure, receive the approval of the Environment Officer for the matters discussed at the site meeting required in Clause 8 of this Licence.

10. The Licence shall construct the structure with an elevation difference in the top deck of six inches between the ends of the deck and the centre of the deck. (Drawing DS-3 submitted with the April 11, 1996 additional information specified an elevation difference of 12 inches.) The interior height of the cells at the centre of the structure shall be 18 inches. (Drawing DS-3 specified a cell height of 12 inches at the same locations.) One cell of the structure shall be constructed with an invert elevation four inches lower than the other cell.

11. The Licencee shall carry out all construction activities and normal maintenance activities between July 1 and October 15 of any year. In particular, no activities relating to the Development which may increase sedimentation in the Drifting River shall occur between April 1 and June 30 of any year.

12. The Licencee shall construct the Development in accordance with the May, 1996 publication "Manitoba Stream Crossing Guidelines for the Protection of Fish and Fish Habitat" published by the Department of Fisheries and Oceans and Manitoba Natural Resources.

13. The Licencee shall ensure that excavated material is piled so that runoff from the pile(s) does not increase sedimentation in the Drifting River.

14. The Licencee shall determine the average streambed elevations of the Drifting River 100 metres upstream of the crossing location, at the crossing location and 100 metres downstream of the crossing location. The invert elevation of the higher waterway opening in the crossing structure shall be six inches lower than the average of the three streambed elevations. This requirement may be varied with the approval of the Environment Officer if the Licencee demonstrates to the satisfaction of the Environment Officer during a site visit that the average of the three elevations at the specified locations is not representative of the streambed elevation in this reach of the Drifting River.

REVIEW AND REVOCATION
1. If, in the opinion of the Director, the Licencee has exceeded or is exceeding or has or is failing to meet the specifications, limits, terms, or conditions set out in this Licence, the Director may, temporarily or permanently, revoke this Licence.

2. If construction of the Development has not commenced within three years of the date of this Licence, the Licence is revoked.

3. If, in the opinion of the Director, new evidence warrants a change in the specifications, limits, terms or conditions of this Licence, the Director may require the filing of a new proposal pursuant to Section 11 of The Environment Act.
