for the construction, operation and maintenance of the Development known as the Brereton Lake 124-12 kV Station located in Pt. 29 and 32-11-15 EPM in the Whiteshell Provincial Park, north of PTH 44, west of PR 307 and south of the existing Seven Sisters to Kenora (SK 1) transmission line, in accordance with the Proposal filed under The Environment Act dated October 12, 2001 and subject to the following specifications, limits, terms and conditions:

In this Licence,

"wetlands" means those areas where the water table is at or above the land surface for a long enough period each year to make the area capable of supporting aquatic or hydrophilic vegetation, and which have soils with characteristics indicative of wet conditions;

"A-weighted sound level" means the sound level measured in dB with a sound level meter set on the A-weighting network; a filter designed to approximate the relative sensitivity of the normal human ear to different frequencies of sound. The unit of measurement is denoted dBA;

"dB (decibel)" means a dimensionless measure of sound level or sound pressure level, where,

sound level = 20 log₁₀ of {sound pressure (actural)}/{sound pressure (reference)};

"dBA" means a denotation used to indicate a unit of sound measurement;

"Leq(1)" means the Leq level for a 1 hour period; and

"Leq (Lequivalent)" means the equivalent A-weighted sound level and is the intensity (dBA) of the constant or steady sound level that would result in exposure to the same total A-weighted energy as would the specified time varying sound, if the constant sound level persisted over an equal time interval.

This Section of the Licence contains requirements intended to provide guidance to the Licencee in implementing practices to ensure that the environment is maintained in such a manner as to sustain a high quality of life, including social and economic development, recreation and leisure for present and future Manitobans.

1. The Licencee shall, prior to construction startup, arrange a pre-construction meeting with representatives of Manitoba Conservation Eastern Region staff in Lac du Bonnet in order to ensure ongoing compliance with this Licence during construction and salvage activities associated with the Development.
   
   
2. The Licencee shall, prior to construction, obtain a Work Permit and a Timber Permit for the construction and salvage work related to the Development.
   
   
3. The Licencee shall, prior to construction, provide a copy of this Licence and related permits to each contractor involved in the construction of the Development.
   
   
4. The Licencee shall, during construction, ensure that any fuel storage areas established for the construction of the Development are located a minimum distance of 100 meters away from waterbodies including wetlands and that the storage areas comply with the requirements of Manitoba Regulation 97/88R - Storage and Handling of Gasoline and Associated Products.
   
   
5. The Licencee shall ensure that all used petroleum products and other hazardous wastes generated by the machinery used in the construction and operation of the Development are collected and disposed of in accordance with Manitoba Conservation and legislative requirements.
   
   
6. The Licencee shall ensure that non-reusable demolition and construction debris from the Development is disposed of at a waste disposal ground operating under the authority of a permit pursuant to the Waste Disposal Ground Regulation, MR 150/91.
   
   
7. The Licencee shall ensure during construction, operation and maintenance of the Development that spills of petroleum or other contaminants are reported to an Environment Officer in accordance with the requirements of Manitoba Regulation 439/87 respecting Environmental Accident Reporting.

8. The Licencee shall, during construction and salvage activities related to the Development, adhere to the Department of Conservation Forest Damage Appraisal and Valuation policy with respect to timber removal and forest damage. Clearing and use of new access trails and borrow pits areas shall require prior approval of Manitoba Conservation, Eastern Region in Lac du Bonnet.
   
   
9. The Licencee shall minimize clearing existing vegetation within and adjacent to the station site property to decrease erosion potential and to provide a visual buffer from the station.
   
   
10. The Licencee shall, prior to commencement of construction activities for the oil containment facilities at the Development, submit to the Director, the results of an Oil Containment Assessment. Oil containment Plans and Specifications, as recommended in the Oil Containment Assessment for the protection of groundwater shall be approved by the Director prior to the commencement of construction of the oil containment facilities.
    
    
11. The Licencee shall construct and install the oil containment equipment as described in the Plans and Specifications approved by the Director as required pursuant to Clause 10 of this Licence.
    
    
12. The Licencee shall not cause or permit emission of sound from the station, which, when measured beyond the property line of the station in a residential area, exceeds an hourly equivalent [Leq(1)] sound level of 45 dBA during the hours of 11:00 p.m. to 7:00 a.m. local time.
    
    
13. The Licencee shall, prior to salvaging the existing Rennie and White Lake Transformer Station sites, determine acceptable levels of any PCB contaminated soils tested from the station sites based on current CCME guidelines. Manitoba Conservation, Eastern Region, shall be notified of any plans for disposal of contaminated soils prior to disposal of the soils.
    
    
14. The Licencee shall use wood poles treated with chromated copper arsenate (CCA) where wood structures are used in wetland areas related to the Development.

1. If, in the opinion of the Director, the Licencee has exceeded or is exceeding or has or is failing to meet the specifications, limits, terms, or conditions set out in this Licence, the Director may, temporarily or permanently, revoke this Licence.
   
   
2. If, in the opinion of the Director, new evidence warrants a change in the specifications, limits, terms or conditions of this Licence, the Director may require the filing of a new proposal pursuant to Section 11 of The Environment Act.
