for the construction and operation of the Development being a water treatment plant and associated facilities located in NW 34-7-20 WPM in the Rural Municipality of Glenwood and in accordance with the Proposal filed under The Environment Act dated June 13, 2002 and subject to the following specifications, limits, terms and conditions:

In this Licence,

"accredited laboratory" means an analytical facility accredited by the Standard Council of Canada (SCC), or accredited by another accrediting agency recognized by Manitoba Conservation to be equivalent to the SCC, or able to demonstrate, upon request, that it has the quality assurance/quality control (QA/QC) procedures in place equivalent to accreditation based on the international standard ISO/IEC 17025, or otherwise approved by the Director;

"approved" means approved by the Director in writing;

"as constructed drawings" means engineering drawings complete with all dimensions which indicate all features of the Development as it has actually been built;

"Director" means an employee so designated pursuant to The Environment Act;

"grab sample" means a quantity of wastewater taken at a given place and time; and

"Standard Methods for the Examination of Water and Wastewater" means the most recent edition of Standard Methods for the Examination of Water and Wastewater published jointly by the American Public Health Association, the American Waterworks Association and the Water Environment Federation.

This Section of the Licence contains requirements intended to provide guidance to the Licencee in implementing practices to ensure that the environment is maintained in such a manner as to sustain a high quality of life, including social and economic development, recreation and leisure for present and future Manitobans.

1. In addition to any of the following specifications, limits, terms and conditions specified in this Licence, the Licencee shall, upon the request of the Director:

1. sample, monitor, analyze or investigate specific areas of concern regarding any segment, component or aspect of pollutant storage, containment, handling, treatment and disposal systems, for such pollutants, ambient quality, aquatic toxicity, seepage characteristics and discharge rates and for such duration and frequencies as may be specified;
2. determine the environmental impact associated with the release of any pollutant from the Development; or
3. provide the Director within such time as may be specified, with such reports, drawings, specifications, analytical data, bioassay data, flow rate measurements and such other information as may from time to time be requested.

2. The Licencee shall, unless otherwise specified in this Licence:

1. carry out all preservations and analyses of liquid samples in accordance with the methods prescribed in the Standard Methods for the Examination of Water and Wastewater or in accordance with equivalent preservation and analytical methodologies approved by the Director; and
2. ensure that all analytical determinations are undertaken by an accredited laboratory.

3. The Licencee shall submit all information required to be provided to the Director under this Licence, in writing, in such form (including number of copies), and of such content as may be required by the Director.
   
   
4. The Licencee shall collect and dispose of all used oil products and other regulated hazardous wastes generated by the machinery used in the construction and operation of the Development in accordance with applicable Manitoba Conservation and legislation requirements.
   
   
5. The Licencee shall, during construction of the Development, implement all necessary measures to prevent the erosion of exposed soil into any waterbodies. Construction adjacent to waterbodies shall not occur during high rainfall events.
   
   
6. The Licencee shall revegetate soil exposed during the construction of the Development with native or introduced grasses or legumes. Native species shall be used to revegetate areas where native species existed prior to construction.

7. The Licencee shall notify the Western Region of Regional Operations not less than two weeks prior to beginning construction of the Development. The notification shall include the intended starting date of construction and the name of the contractor responsible for the construction.
   
   
8. The Licencee shall, at least two weeks prior to construction of the Development, contact the Historic Resources Branch to make arrangements for inspection of the water discharge pipeline route and discharge point. If requested by Historic Resources Branch, the Licencee shall implement and comply with a heritage resource management strategy.
   
   
9. The Licencee shall dispose of non-reusable demolition and construction debris from the Development at a waste disposal ground operating under the authority of a permit issued under Manitoba Regulation 150/91 respecting Waste Disposal Grounds.
   
   
10. The Licencee shall establish fuel storage and equipment servicing areas for the construction and operation of the Development such that:

1. they are located a minimum distance of 100 metres from any waterbody; and
2. they comply with the requirements of Manitoba Regulation 188/2001 respecting Storage and Handling of Petroleum Products and Allied Products.

11. The Licencee shall, during construction and operation of the Development, report spills of fuels or other contaminants to an Environment Officer in accordance with the requirements of Manitoba Regulation 439/87 respecting Environmental Accident Reporting.
    
    
12. The Licencee shall use only non-phosphorous additives in the boilers.
    
    
13. The Licencee shall conduct a plant effluent monitoring program as described in Clauses 14 to 17 of this Licence for a period of two years commencing with the operation of the Development. The duration of the monitoring program may be varied by the Director if the results, in the opinion of the Director, indicate that a longer or shorter monitoring period is appropriate.
    
    
14. The Licencee shall, on a quarterly basis for the duration of the plant effluent monitoring program:

1. collect grab samples from the discharge water line; and
2. measure the flow of effluent in the discharge water line.

15. The Licencee shall transport the grab samples collected pursuant to Clause 14 of this Licence to an accredited laboratory for analysis. The samples shall be stored and transported in accordance with procedures specified by Manitoba Conservation to ensure that the samples are suitable for analysis.
    
    
16. The Licencee shall have the samples collected pursuant to Clause 14 of this Licence analyzed for the following parameters:

pH; temperature; conductivity; total dissolved solids; total suspended solids; total alkalinity; chloride; sodium;

hardness; sulphates; total nitrogen; ammonia nitrogen; nitrate/nitrite nitrogen; total Kjeldahl nitrogen; total phosphorous; iron.

The parameters of the monitoring program may be varied by the Director if the results, in the opinion of the Director, indicate that it is appropriate.

17. The Licencee shall, not more than 60 days after the results of each quarterly analysis are available, submit the results to the Director.
    
    
18. The Licencee shall actively participate in any future watershed or drainage basin management plan, approved by the Director, for the Souris River and associated waterways and watersheds.
    
    
19. The Licencee shall, each winter during the operation of the Development, monitor ice accumulation from the Development discharge in the ravine area downstream of the effluent discharge point. Appropriate action shall be taken as necessary to prevent flooding due to ice accumulation from the operation of the Development on land downstream of the effluent discharge point that is not controlled by the Licencee.
    
    
20. The Licencee shall, each year during the duration of the plant effluent monitoring program, consult with livestock producers along the discharge route to the Souris River to ensure that the effluent discharge is not causing an unacceptable impact to livestock health. The results of the consultation shall be reported to the Director.
    
    
21. The Licencee shall:

1. prepare "as constructed drawings" for the Development, and shall label the drawings "As Constructed"; and
2. provide to the Director, within three months of the completion of construction of the Development, two sets of "As Constructed" drawings.

1. If, in the opinion of the Director, the Licencee has exceeded or is exceeding or has or is failing to meet the specifications, limits, terms, or conditions set out in this Licence, the Director may, temporarily or permanently, revoke this Licence.
   
   
2. If the Licencee has not commenced construction of the Development within three years of the date of this Licence, the Licence is revoked.
   
   
3. If, in the opinion of the Director, new evidence warrants a change in the specifications, limits, terms or conditions of this Licence, the Director may require the filing of a new proposal pursuant to Section 10 of The Environment Act.
