III. Adoption


F. Recommendations

Generally:

  1. That the right of common-law partners to apply to adopt jointly with a common-law partner, be extended to include same-sex common-law partners.
  2. That the right of common-law partners to apply to adopt the biological child or extended family member of an applicant's common-law partner, be extended to include same-sex common-law partners.


The Adoption Act:

  1. That the definition of "extended family" in section 1 be amended to include adults who are cohabiting in a conjugal relationship of some permanence with a member of the same-sex.
  2. That sections 36, 73(1), and 88 be amended to permit a joint application for adoption to be made by same-sex cohabiting partners that are in a conjugal relationship of some permanence.
  3. That Form AA-14 in Adoption Regulation A2 - 19/99 be amended to permit a "declaration of commitment" to be made by same-sex cohabiting partners that are in a conjugal relationship of some permanence.


The Vital Statistics Act:

  1. That Forms 3, 4, 4A, 6, 9, 11, and 16 to the regulations of the Vital Statistics Act be amended to ensure that a birth certificate can register either two parents of the same gender if appropriate.
