The Issue Regarding the Twine

Recommendation

  • Whenever the police seek to link material at a crime scene to a particular geographic location or a specific manufacturer which, in turn, links an accused to a crime, that material must be tested if a test can identify a specific location or manufacturer. The duty to perform the test lies with the prosecution, whether it be the police or the Crown. The failure to perform the test on the material in question constitutes a serious omission. As a consequence of that omission, evidence as to the material's location or provenance must be ruled inadmissible.
