What is a Director's Order Requiring a Higher Standard?

Under The Technical Safety Act, the Director may require regulated equipment or regulated work to meet a higher standard than would otherwise apply, where the higher standard is necessary to minimize a technical safety risk. You may receive a director's order requiring a higher standard if, for example:

• your equipment or work presents unique or elevated risks;
• new or emerging technologies require additional safeguards; or
• the design, condition, use or location of equipment creates a technical safety risk

The written order explains:

• The higher standard being required;
• Why it is required; and
• The timeframe for compliance

Request for reconsideration:

You may submit a request for reconsideration within 14 days of receiving of the order.

The Technical Safety Regulation establishes a process for requesting a variance from prescribed requirements where an equivalent level of safety can be demonstrated. Variances provide flexibility to address unique site conditions or circumstances while upholding safety standards.

Variances are available for:

• Amusement Rides - Schedule B; and
• Elevating Devices - Schedule C
