Alexander Christie Esquire 10th Sept 1829 Chief Factor &c. {..} The last Will & Testament of Alexander Kennedy In the event of {…..} death this is to be opened by the above Gentleman or his successor at Moose Factory AK

In the Name of God. Amen. I Alexander Kennedy of the Parish of South Ronaldshay, County of Orkney but now in the Service of the Honourable Hudson’s Bay Company at Moose Factory North America being of sound mind & memory, do make, & declare this to be my last Will & Testament viz.

In the first place I order all my just debts to be paid and satisfied and after payment of every part thereof I give & bequeath all the monies and effects I may be possessed of at the time of my decease as follows,

To my dearly beloved Sisters Mary & Isabella, (both of St. Margarets’ Hope So Ronaldshay) I leave the Sum of three Hundred Pounds Sterling each to be paid to them by my Executor hereafter named out of the monies that may be due to me by the Honourable Hudson’s Bay Company.

The Sum of Four Hundred Pounds Sterling lent to my brother in Law James Allan on security as per deed in my Sister Mary’s possession I leave to my beloved Niece Eliza Allan – as a token of my remembrance and regard one Hundred Pounds of which she is to pay to her Brother Alexander my Namesake – as a small memorandum from me to him.

The Farm, or land of the Braehead I also leave to my two Sisters named above with the Houses thereon and the several little detatched [sic] spots of ground appertaining thereto, the whole thereof to {…} be divided between them as they shall agree on or the whole may be valued and my Eldest Sister may keep the property on paying our Sister Isabella half the value fixed on or agreed on between them.

All the rest of the monies & effects whatsoever that I may die possessed of I give and bequeath to my beloved wife Aggathas alias Mary Kennedy and my beloved children by her namely: John, Mary, Alexander, Elizabeth, William, George, Phillip, Isabella & Roderick. That is to say all the Stock standing in my name in three perCent consolidated funds also what may be standing in my name in the three pCent Reduced Annuities, the principal as well as the Interest thereof together with what may be in the names of my agents Alexander Lean Esquire & William Smith Esquire both of London. Once all the monies that may be due to me by the Honourable Hudson’s Bay Company at the time of my decease as well as what may be forthcoming to me by virtue of the Commission I hold as Chief Factor in their Service the whole later divided amongst my above named Wife & Children as follows – that is after paying the Legacies above mentioned to my two sisters.

To my beloved Wife above named I leave an Annuity of Twenty Pounds Sterling to be paid her during her life time and all the rest of the residue of my above mentioned property I leave to be equally divided amongst my Children above named the Principal & Interest thereof to share & share alike, and it is my will & desire that after the decease of my beloved wife that the principal providing her annuity may be divided amongst the rest of my surviving Children. And it is further my will & desire that my Executor hereafter named does receive from the Honourable Hudson’s Bay Company all sums as it becomes due to me and that he divides it according to my will and desire as above stated, and that he purchases Stock therewith in the name of each of the individuals concerned (that is my Children above mentioned) in the three per Ct Annuities or any other good security in the Bank of England dividing also the residue of my already funded property amongst them in the manner above stated after setting aside as much as shall provide Twenty Pounds Annually to be paid to my beloved Wife as above stated – and it is further my wish & desire that the Interest only of the shares falling to each of my above named Children be paid for ten years after my decease after which period the Principal as well as the Interest may be at the disposal of each to do with it as he or she thinks proper. In the event of any of my above named Children dying without issue his or her share to be equally divided among the survivors.

I do hereby nominate & appoint William Smith Esquire Secretary to the Honourable Hudson’s Bay Company or the existing Secretary to the said Company for the time being to be the Executor of this my last Will & Testament Hereby empowering him to do and act for me in the above trust as he shall see needful & expedient and I hereby request that my Executor above named do retain in his own hands as a remuneration for the trouble I have hereby imposed on him a moderate commission on all transactions I have hereby intruded on him.

In witness whereof I have hereunto set my hand & Seal this tenth day of September in the Year of Our Lord One Thousand Eight Hundred and Twenty Nine

Signed, Sealed published and declared by the said Alexander Kennedy as his last Will & Testament in the presence of us, who in the presence of the Testator have hereunto subscribed our names --
