Appeals


An accused is entitled to appeal a disposition to the Manitoba Court of Appeal.

An appeal may be based on a question of law, of fact, or both. Pursuant to section 672.78 (1), the Court of Appeal may allow the appeal if:

  1. the disposition is unreasonable or cannot be supported by the evidence
  2. is based on a wrong decision on a question of law
  3. there was a miscarriage of justice

The timeframe for submitting an appeal is 15 days from receipt of the placement decision or disposition, and reasons for it.
