A dangerous incident or technical safety risk is an event, condition or circumstance involving regulated equipment or regulated work that causes, or has the potential to cause, serious personal injury, death or property damage.

It also includes the failure of a safety feature of regulated equipment or safety equipment used in regulated work.

You must report a dangerous incident or technical safety risk if it arises from the use of regulated equipment or the performance of regulated work and:

• causes, or has the potential to cause, serious personal injury, death or property damage; or
• involves the failure of a safety feature of regulated equipment or safety equipment used in regulated work.

This includes near-miss events where no injury or damage occurred, but where the outcome could reasonably have been more serious.

When there is uncertainty about whether an event, condition or regulated work must be reported, it should be reported.

The duty to report applies to:

• the owner of regulated equipment;
• the holder of an installation permit or operating permit; and
• any person performing regulated work.

All responsible parties share the duty to ensure the incident or risk is reported. Only one report is required for each event.

A report must be made as soon as reasonably practicable after:

• the dangerous incident occurs; or
• the technical safety risk is identified.

Anything at the site of a dangerous incident must not be removed, disturbed or interfered with except to:

• rescue a person or prevent injury or death;
• protect property;
• comply with the law; or
• follow any additional directions from Inspection and Technical Services.

Yes. The Technical Safety Act protects employees from retaliation. An employer must not dismiss, suspend, penalize, discipline or discriminate against an employee for reporting a dangerous incident or technical safety risk.

Retaliation is a serious matter and may result in enforcement action by ITS, including suspension or cancellation of permits or licences, refusal of renewals or reinstatements, administrative penalties, prosecution or referral to other authorities, where appropriate.

After a report is received, ITS may:

• review the information;
• request additional details;
• attend the site;
• require corrective action;
• issue orders; or
• take enforcement action where appropriate.

All reports are reviewed and recorded. Not all reports require investigation.
