Appeal Board

Apprenticeship Manitoba is responsible for the administration of the apprenticeship program and certification for the designated trades in Manitoba and makes every effort to be fair and transparent with processes and decisions.

If an apprentice, trade qualifier or employer disagrees with a decision by the Executive Director of Apprenticeship Manitoba, they may appeal to the Apprenticeship and Certification Appeal Board (Appeal Board).

The Appeal Board deals only with appeals regarding the apprenticeship and certification system and operates independently from the Apprenticeship and Certification Board and Apprenticeship Manitoba.

The Appeal Board is:

The Appeal Board has the authority to confirm, vary or rescind decisions made by the Executive Director, or to refer the decision back to Apprenticeship Manitoba for reconsideration. It does not have the authority to order a repeal of, or amendment to, a section or sections in trade regulations or in the act.

Pre-Appeal Consultation

    Step One – Decision at the Program Level


    This would typically include a decision made by the program staff, typically an Apprenticeship Training Coordinator or Trade Qualification Assessor, responsible administering the apprenticeship and trade qualification programs.


    You must initiate in writing your disagreement of the decision or action taken by Apprenticeship Manitoba to the program staff within five (5) business days of being informed of the decision or action being disputed.


    You must clearly outline why you disagree with the decision or action and you are responsible to supply all relevant information for consideration. Apprenticeship Manitoba will make effort to seek a resolution between the client and program staff.

    Step Two – Decision by the Executive Director


    When a resolution cannot be found at step one, you must initiate in writing your disagreement of the decision or action taken by the program staff to the Executive Director of Apprenticeship Manitoba within 10 business days of being informed of the outcome.


    The Executive Director will make decisions related to matters as identified in The Apprenticeship and Certification Act – Appeals of Decisions Made by the Executive Director.


    Clearly outline the situation, steps taken for resolution, relevant information provided to the program staff and outcome. The Executive Director will consider only the information you provided to program staff at step one.


    If you contact the Executive Director beyond the ten working days period, you must provide written reasons for the delay.

Formal Appeal Process

    Step Three – Initiation of Formal Appeal Process


    When a resolution cannot be found at step two, you must file a Notice of Appeal Application Form with the Appeal Board within 30 days after receiving the written notice from the Executive Director of the decision that you are appealing. Make sure to review the Appellant’s Guide prior to submitting a Notice of Appeal Application Form to the Appeal Board.


    The Appeal Board’s decision is final. No further appeals may be made.


  • The appeal may be resolved at any stage of the process with the mutual agreement of all parties.
